A
third judge of the Bombay high court will hear the issue of whether the
BMC can fix property tax on the basis of the steep market rents that are
actually received by members of a cooperative housing society instead of
the standard rent.
The matter is before a third judge after a two-judge HC bench gave a split verdict last September
in the litigation, which has been pending since 2004, between the BMC
and Dalamal Towers Premises CHS. The BMC said it was entitled to
calculate the rateable value relying on market rent and had in early
2000 fixed value for Dalamal Towers as Rs 53 lakh. The matter is
scheduled before Justice D Y Chandrachud.
