www.mumbaipropertyexchange.com is privately owned website/portal promoted by M/s.Realty Software and Solutions hereinafter referred to as "MPE".

MPE is a website providing online and off line real estate buying/leasing/selling and advisory and general real estate broking services and provides property related information to its Basic and Premium Members as per the terms and conditions outlined herein.

You, as a website surfer, Basic or Premium Member or a general web browser are free to surf the website and its pages as desired. Certain information and Sections of our website are available only after duly subscribing and paying a subscription fee on line. Membership Benefits Premium Members get details like Plans, Digital Pictures, Rates, Reviews and Ratings on projects available in Mumbai, Navi Mumbai and Thane. The Premium Member services are extended only for New Properties which are offered by Builders Only.

Premium Membership is only for New Properties
The data on Re-sale and Lease properties is not part of the Premium Membership and Brokerage Fees is applicable for transaction on those. Brief information about the properties can be provided subject to availability. No refund shall be allowed if the Premium Member fails to see this fine print and still becomes a Premium Member and asks for information on Re-Sale/Lease Properties.

A. Plans, Digital Pictures, Reviews
Premium Members are entitled to see the details of the regularly updated projects offered by all the Builders with complete details, indicative rate history, digital pictures and plans etc. Premium Members are only entitled to get the Data on New Projects only.

B. Refund
MPE shall only be liable for a refund 3 Times the Membership Fees of a maximum to Rs.3000/- , even if you have subscribed for a 6 Months or 12 months or any tenure only for 1 property. The refund is only allowed to Premium Members who buy negotiate, inspect and finalize a particular property with the assistance of our office executives who have also accompanied you to the project. The refund is usually given after your making payment of 40% to the Builder and completion of the required paper work. Members not opting for refund get an extra year membership free of cost. Certain properties are listed by Sole Selling Agents of the Builders and Brokerage Fees of 1% shall be applicable for those projects and no refund will be allowed on those select properties.

C. Rate Alerts
The premium and platinum members get rate alerts of the projects shortlisted on MPE from time to time.

D. Limited Liability
Realty Software and Solutions takes no responsibility and authenticity of the information provided as the information is from 3rd Party sources although a lot of care is taken to ensure that the information in regards to the Under Construction properties.

Since, the information comes from the end of the 3rd Party it may not be genuine and the surfer or Member’s hereby confirms that he/she/they shall not hold MPE directly or indirectly responsible for any information which may be in correct in any way or form.

E. Displaying of Information
Keeping in mind the complexity of the real estate business in Mumbai & India certain information in regards to pricing etc. is not displayed and it shall not be obligatory for MPE to display the same in any form or context. The sole discretion on displaying of property details in regards to building information, prices, plans, pictures etc. rests with the management of MPE.

All Members should verify the information once before taking any commercial decision as in the real estate market there is always a change expected and any information can become redundant pretty easily.

The Property Sellers are required to fill in the data as required at their own discretion and MPE has the right to charge the Seller Service/Brokerage charges in the event of a transaction.

MPE contains general and formal information on real estate projects available with pictures, plans etc. of various builders which are freely available and advertised in news papers, internet, media and by way of hoardings, display boards, information available in Sales offices of builders and real estate agents.

The legal information and other related information is available for mere guidance and the visitors and members are requested to consult their respective lawyers or chartered accountants before making any commercial decision.

Section containing advice in regards to Investments, market reviews, project update and analysis should be absorbed with the extreme caution.

Any content, pictures, plans, data etc. copying from the website www.mumbaipropertyexchange.com shall be deemed as violation of the copyright and liable for legal action.

Each Visitor/member of MPE is responsible for doing their own research, due diligence and inspections to ensure they understand and have the true & current facts about their property they intend purchasing.

MPE shall have the right to deny, disqualify any premium/platinum member/s or corporate membership. The sole discretion of membership rests with the management of MPE and if you are a premium or a Platinum member your membership can be disqualified/cancelled and the amount shall be refunded to you without the responsibility of assigning any reason or any further obligation.

The relationship between the Visitors/Members and MPE is merely a membership for providing Services as mentioned in the website. You must conduct your own independent investigation to verify the accuracy of any and all property information contained on this website.

In no event shall MPE be liable for loss or lost profits or any incident or consequential damages however arising including negligence out of or in connection with the visit to this website.

MPE shall be governed in all respects by the laws of the State of Maharashtra and it shall fall under the Courts of Mumbai and in Mumbai Jurisdiction only.

We do not guarantee continuous, uninterrupted or secure access to our services, website and operations of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Restricted Membership
Your becoming a premium member is an approval to the terms and conditions as mentioned here in above. Real estate agents, builders are requested to contact our office for subscription as platinum members only. If any real estate consultant or builder or any one related to the real estate broking profession becomes a Premium Member his/her membership will be terminated immediately and the management of MPE reserves the right to do so without assigning any further reason or explanation. After termination the refund of the amounts after deduction of incidental charges and service tax shall be paid back.
