The Maharashtra state government has announced a significant initiative to address the backlog of recovery warrant cases under the Maharashtra Real Estate Regulatory Authority (MahaRERA). The state revenue minister has committed to resolving all pending cases within the next three months, a move that aims to expedite justice for homebuyers who have been affected by these delays.

Current Status of Recovery Cases

As per the latest figures, there are a total of 1,342 recovery warrant complaints lodged with MahaRERA. However, only 316 of these cases have been executed by the collectorates, highlighting a significant gap in the recovery process. The data indicates that the Mumbai suburban and Pune districts are particularly affected, accounting for over 60% of the total outstanding recovery amount.

Financial Implications

In Mumbai suburban, there are 540 complaints with an outstanding amount of Rs 424.79 crore. Of this, only Rs 80.49 crore has been recovered so far. Pune district follows closely with 274 complaints totaling Rs 219.71 crore, from which authorities have managed to recover just Rs 42.31 crore. This leaves a substantial amount still pending, raising concerns among homebuyers about the effectiveness of the recovery process.

Government Commitment and Activist Concerns

The minister's announcement reflects a commitment to improving the recovery process and ensuring that justice is served to affected homebuyers. However, activists have voiced skepticism regarding the three-month timeline, suggesting that it may not be realistic given the complexity and duration of many pending cases. Activist Ramesh Prabhu has called for a more structured approach, advocating for the implementation of a Standard Operating Procedure (SOP) and a phase-wise recovery execution plan. He also pointed out the need for a tracking system similar to that used by UP RERA, which allows for better monitoring of recovery warrant orders.

Challenges in Execution

Another challenge facing MahaRERA is the delay in appointing officials who can expedite the recovery process. Although there have been suggestions to involve retired tehsildars to help manage the backlog in the Mumbai suburban and Pune areas, only one officer has been appointed so far. This lack of manpower could hinder the timely resolution of cases, making the minister's three-month target even more ambitious.
