Carpet Area Dispute Reaches Consumer Commission

A Mumbai property dispute has highlighted the consequences of delivering a residential unit with less carpet area than specified in the registered agreement.

The case concerned a flat in Shree Balaji Ashirwad, Malad West, where the agreement for sale promised 560 sq ft of carpet area.

After possession was delivered in November 2016, the buyer commissioned a registered architect to measure the premises.

The resulting measurement was 518.46 sq ft — a shortfall of 41.54 sq ft.

Developer Failed to Provide Counter-Measurement

The developer challenged the architect's findings, but the Commission noted that it had not produced an independent expert measurement or counter-architectural survey.

Consequently, the Commission found the buyer's registered architect's measurement credible.

It held that delivery of a smaller carpet area than expressly stated in a registered agreement amounted to deficiency in service and an unfair trade practice.

Compensation Totals ₹7.39 Lakh

At the claimed rate of ₹16,000 per sq ft, the 41.54 sq ft deficit was valued at ₹6,64,640.

In addition to this amount, the developer was ordered to pay ₹50,000 for mental agony and harassment and ₹25,000 towards legal expenses.

The total fixed award therefore stands at ₹7,39,640, plus 9% simple interest on the ₹6.64 lakh area-shortfall amount from the filing date until payment.

Possession Does Not Necessarily End Developer Obligations

The Commission also dealt with the project's incomplete statutory compliances.

It noted that a Part OC had been issued for the second to sixteenth floors while structural deviations remained on the lower levels. The order required the developer to address pending compliances and facilitate society formation within four months.

For brokers and buyers, the case demonstrates why carpet area in the registered agreement should be checked against the physical premises rather than relying solely on marketing material or possession documentation.

A small difference in carpet area can translate into a significant financial amount in Mumbai. Accurate documentation and independent measurement can become crucial when there is a dispute over what was actually delivered.
