Panvel Homebuyer Gets ₹86 Lakh Refund Order After 10-Year Delay

A Mumbai consumer commission has directed developer Soundlines Eco Homes and its partners to refund approximately ₹86.37 lakh, including interest, to a homebuyer who waited nearly ten years for possession of an apartment in Panvel.

The ruling concerns the Sound Delight residential project and highlights the legal remedies available to buyers facing prolonged possession delays.

Flat Booked in 2015, Possession Delayed Until 2026

Mulund resident Tapan Visaria booked an 876 sq ft carpet-area apartment in Sound Delight at Aashte village, Panvel, for ₹50.52 lakh in August 2015.

Under the registered agreement, possession was scheduled for December 31, 2016. However, the project faced repeated delays, with the MahaRERA website subsequently reflecting an extended completion date of September 30, 2026.

Despite paying approximately ₹45.45 lakh towards the property, the buyer did not receive possession within the agreed timeline.

Consumer Commission Orders Refund With 9% Interest

The Additional District Consumer Disputes Redressal Commission, Mumbai Suburban, held that the developer's failure to deliver possession constituted a deficiency in service.

The commission directed Soundlines Eco Homes and its partners to refund the amount paid, along with 9% annual interest calculated from December 31, 2016, until actual payment.

The reported refund, including accrued interest, amounts to approximately ₹86.37 lakh. The buyer was also awarded ₹50,000 for mental agony and ₹25,000 towards litigation expenses.

The commission declined a separate claim of ₹5.23 lakh for housing-loan interest, observing that the loan was an independent financial arrangement between the purchaser and the bank.

What This Means for Mumbai Homebuyers

The decision reinforces that buyers facing prolonged construction delays can seek refunds through consumer dispute redressal mechanisms.

It also highlights the importance of checking MahaRERA registration details, possession deadlines, construction progress and developer track records before purchasing an under-construction property.

For buyers across Mumbai, Navi Mumbai and Panvel, the case demonstrates that repeated project extensions do not automatically eliminate a developer's contractual obligations.

Expert View by Sandeep Sadh

"Homebuyers should carefully verify possession commitments and project progress before investing. Clear agreements and regular checks of MahaRERA records are essential when purchasing under-construction properties."
