Maharashtra bars registration of unauthorised construction documents

Maharashtra bars registration of unauthorised construction documents
Share𝕏fin

The Maharashtra government has barred the registration of documents relating to unauthorised constructions, a decision that reaches straight into the daily mechanics of buying and selling property in Mumbai and the wider MMR. For anyone who has ever been told "the building is fine, only the paperwork is pending", this closes one of the oldest escape routes in the market.

Until now, a surprising amount of MMR stock moved on the strength of an agreement, an index-II entry or a notarised document, with the actual conveyance and society paperwork trailing years behind. That gap is where unauthorised floors, unapproved wings and structures built beyond sanctioned plans quietly changed hands. By refusing registration to documents connected to unauthorised construction, the state is effectively saying that such transactions will no longer get the legitimacy of a registered record.

The practical consequence is a harder, cleaner market. A buyer who cannot register a document cannot easily raise institutional finance against it, cannot rely on it in a court of law with the same comfort, and will find resale far more difficult. Sellers of compromised stock lose their most persuasive argument — that the deal is "almost" regular. For developers sitting on approvals that have lapsed or plans that were never fully sanctioned, the incentive to regularise before selling has just become much stronger.

For Mumbai and MMR specifically, where redevelopment, gaothan properties, cessed buildings and older layouts throw up layers of legacy irregularity, this is not a small technicality. It is a filter. Expect transactions in well-approved, RERA-registered projects to move faster, and expect the informal, cash-heavy end of the market to slow down as buyers ask sharper questions about sanctioned plans and occupation certificates.

Sandeep's take: I have spent enough years in this market to know that buyers rarely lose money on location — they lose it on paperwork. This order does not create a new problem; it simply stops the market from pretending the problem does not exist. If your seller cannot produce a sanctioned plan, an occupation certificate and a clean chain of title, treat the discount you are being offered as the cost of a risk you are being asked to carry. In most cases, it is not worth it.

What to watch next: How registration offices in Mumbai, Thane and Navi Mumbai implement the bar in practice, and whether we see a rush to regularise or litigate before transactions get stuck.
