www.mumbaipropertyexchange.com is privately owned website/portal promoted by M/s. Mumbai Property Exchange Pvt. Ltd. a real estate broking firm, engaged in the business of selling, leasing and buying property on commission basis, hereinafter referred to as "MPE" or the "Company".
By virtue of You herein after referred to also as the â€œParty/Userâ€ becoming a Premium or Platinum Member you are agreeable by default of the terms and conditions mentioned herein below.
01. â€œMPEâ€ is a website providing online research and off line real estate buying/leasing/selling and advisory and general real estate broking services and provides property related information to its Basic and Premium Members as per the terms and conditions outlined herein.
02. You, as a website surfer, Basic or Premium Member or a general web browser are free to surf the website and its general pages as desired. Certain information and Sections of our website are available only after duly subscribing and paying a subscription fee on line and thus applicable only for Premium Members. Premium Members get details like Plans, Digital Pictures, Rates, Reviews and Ratings on projects available in Mumbai, Navi Mumbai and Thane. The Premium Member on line research services are extended only for New Properties which are offered by Builders only and not for resale properties.
03. Premium Membership Research Service is only for New Properties and MPE does not charge you any Brokerage Fees for buying such off plan properties or ready possession properties marketed directly by the developers/builders.
If any Premium member shortlist more than 100 properties a day then his membership shall be suspended till further discussion and ascertaining the genuineness of the client. No Member is allowed to part with his user name and password to any other person/body for useage. The membership in such case will be terminated.
04. The listings of Re-Sale and Lease Properties is not part of the Premium Membership and Brokerage Fees is applicable for transaction. We charge 1% of the total sale value as Brokerage Fees for Re-Sale Properties and 1 month rent equivalent for Leasing with Service Tax as applicable. No refund shall be allowed if the Premium Member fails to see this fine print and still becomes a Premium Member and asks for information on Re-Sale/Lease Properties.
05. Premium Members are entitled to see the details of the regularly updated projects offered by all the Builders with brief project details, indicative rate history, digital pictures and plans etc. Premium Members are only entitled to get the Builders Name and the Project Name on New Projects only and not for resale or lease properties. MPE acts as a Link between you and the developers to enable you to transact with maximum information. The User has access to only his own data and information stored in the database at MPE (subject to prior confirmation of identity) and nothing more. The User may edit or amend such data and information from time to time.
06. MPE shall not be liable for any kind of refund for the membership fees for services either not used or for any reason what so ever. In case of technical problem from MPE side, then at the sole discretion of MPE the membership can be extended for the days where the connectivity was lost.
07. MPE takes no responsibility and authenticity of the information provided as the information is subject to change, amendment etc. at the time of viewing the property information although a lot of care is taken to ensure that the information in regards to the Under Construction properties. We have a 60-75 days of cycle for rate updations and pictures of the properties are updated 2 to 3 times a year depending on construction etc. Certain areas pictures are not available due to various constraints.
08. Since, the information comes from the Sales Teams/offices/Authorised Agents of the developers/builders etc. it may not be absolutely correct as some times the developers do not give us the correct picture over the telephone etc. and the surfer or Memberâ€™s hereby confirms that he/she/they shall not hold MPE directly or indirectly responsible for any information which may be in correct in any way or form.
09. Keeping in mind the complexity of the Real Estate Business in Mumbai, Thane and Navi Mumbai, certain information in regards to pricing etc. is not displayed and it shall not be obligatory for MPE to display the same in any form or context. The sole discretion on displaying of property details in regards to building information, prices, plans, pictures etc. rests with the management of Mumbai Property Exchange.com (MPE).
10. All Research and Analytics on MPE are indicative and MPE shall not be responsible for any variation in the same or if it is contrary to the market conditions.
11. All Members should verify the information once before taking any commercial decision as in the real estate market there is always a change expected and any information can become redundant pretty easily.
12. The Property Sellers are required to fill in the data as required at their own discretion and MPE has the right to charge the Seller Service/Brokerage charges in the event of a transaction.
13. MPE contains general and formal information on real estate projects available with pictures, plans etc. of various builders which are freely available and advertised in news papers, internet, media and by way of hoardings, display boards, information available in Sales offices of builders and real estate agents.
14. The legal information and other related information is available for mere guidance and the visitors and members are requested to consult their respective Lawyers or Chartered Accountants before making any Commercial Decision.
15. Section containing advice in regards to Investments, market reviews, project update and analysis should be absorbed with your own discretion.
16. Any content, pictures, plans, data etc. copying from the website www.mumbaipropertyexchange.com shall be deemed as violation of the copyright and liable for legal action.
17. Each Visitor/member of MPE is responsible for doing their own research, due diligence and inspections to ensure they understand and have the true & current facts about their property they intend purchasing.
18. MPE shall have the right to deny, disqualify any premium/platinum member/s or corporate membership. The sole discretion of membership rests with the management of MPE and if you are a premium or a Platinum member your membership can be disqualified/cancelled and the amount shall be refunded to you without the responsibility of assigning any reason or any further obligation.
19. The relationship between the Visitors/Members and MPE is merely a membership for providing Services as mentioned in the website. You must conduct your own independent investigation to verify the accuracy of any and all property information contained on this website.
20. In no event shall MPE be liable for loss or lost profits or any incident or consequential damages however arising including negligence out of or in connection with the visit to this website.
21. MPE shall be governed in all respects by the laws of the State of Maharashtra and it shall fall under the Courts of Mumbai and in Mumbai Jurisdiction only.
22. We do not guarantee continuous, uninterrupted or secure access to our services, website and operations of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. 23. Restricted Membership
Your becoming a premium member is an approval to the terms and conditions as mentioned here in above.
a. Real Estate Agents, Builders/Developers, RESEARCH AGENCIES/BANKS/INSTITUTIONS are requested to contact our office for subscription as platinum members only.
b. If any Real Estate Agents, Builders / Developers, RESEARCH AGENCIES / BANKS / INSTITUTIONS or any one related to the real estate broking profession becomes a Premium Member his/her membership will be terminated immediately and the management of MPE reserves the right to do so without assigning any further reason or explanation. The Premium Membership Paid Shall Not Be Refunded.
c. No REFUND of any fees shall be given to the Real Estate Agents, Research Agencies or any Developer who has taken a Premium Membership. However, in case of taking a Platinum Membership, the premium membership paid will be adjusted accordingly.
d. For Real Estate Agents and Developers and other Service Providers we are offering a Platinum Membership. Please call our office for more details on the same.
e. For Allied Services like interior designers, architects and other related activities you need to become a Platinum Member and you need to call our Mumbai office on +91 22 66921122 to understand the terms and conditions.
24. The Company reserves the unilateral right to add to /and/or change and/or delete and/or end the Service at anytime with or without notice to the User. Except for paid service, a pro-rated refund shall be effected for the remaining unused period.
There shall be no liability on behalf of the Company to the User or any third party in case the Company exercises its unilateral right to modify or discontinue the Service.
25. The right to amend vary or change the terms and conditions contained herein and in the Services Guide at any time exclusively rests with the Company, upon notice (in such form as may be determined by the Company) to the User.
26. This Agreement will be periodically undated and the Terms and Conditions changed from time to time and the changed or updated Agreement posted at MPE. The User should visit the site periodically to review the latest Terms and Conditions. For the avoidance of doubt, the User's continued use of the Service constitutes an affirmation and acknowledgement of the amended terms and conditions.
