MahaRERA Directs L&T to Complete Pending Crescent Bay Repairs

Crescent Bay Residents Get MahaRERA Relief

MahaRERA has directed the developer of Crescent Bay Tower 5 in Parel to complete several pending rectification and safety works following a complaint filed on behalf of the housing society.

The September 3 order directs L&T Parel Project LLP, a joint venture between Larsen & Toubro Realty and Omkar Realtors & Developers, to expedite the unresolved works.

The case is significant for developers and housing societies because the dispute continued several years after possession had been handed over.

Five Major Issues Raised by Society

Residents sought action concerning five areas: an incomplete automatic fire alarm system, project-boundary demarcation, recurring leakages, other building deficiencies and unpaid contributions from neighbouring towers towards common-area expenses.

Photographic evidence and submissions made during proceedings indicated that comprehensive rectification had not yet been completed, according to MahaRERA.

Possession Dates Back to 2018

Tower 5 received its occupancy certificate from the Slum Rehabilitation Authority on March 15, 2018, and possession was handed over by September 4 that year.

Despite this, residents continued pursuing concerns involving the building and common infrastructure.

L&T Realty's current project information identifies Crescent Bay as a RERA-registered, ready-to-move residential development in Parel comprising multiple towers.

Reporting Defects on Time Proved Important

One of the most relevant findings concerns the defect-liability period.

MahaRERA recorded that the complaints had been raised before the statutory periods expired. It therefore held that expiry of those periods later could not wipe out defects that had already been reported but remained unresolved.

For developers and housing societies, the case highlights the importance of maintaining clear documentation of defect notifications, repair requests, correspondence and rectification work after possession.

Sandeep Sadh’s Take:

β€œFor both developers and societies, documentation after possession is critical. When defects are reported within the prescribed period, there should be a clear record of the complaint, action taken and final resolution.”
