Mumbai Clears OC Amnesty Scheme for Eligible Pre-2016 Buildings

Mumbai has cleared an Occupation Certificate amnesty scheme for eligible buildings that were occupied before November 2016 but do not yet have an OC.
For flat owners, an OC is an important document. It confirms that a building has received approval for occupation under the applicable planning process. Without it, owners can face complications during resale, home-loan processing, inheritance, redevelopment and other property transactions.
The scheme may offer a route forward for eligible buildings that have remained occupied for years despite the absence of an OC. However, it should not be seen as an automatic regularisation of every non-OC building. Eligibility will depend on the building’s approvals, occupation status, compliance position and the detailed conditions of the scheme.
For buyers considering resale homes, this is a significant development but not a substitute for due diligence. Before paying a token amount, buyers should check whether the building has an OC, whether it may be eligible under the scheme, and what steps the society or developer has already taken.
For societies, the immediate priority is to understand the application procedure, collect relevant approvals and coordinate with qualified professionals. Delays in action could affect the ability to benefit once the implementation process begins.
The larger value of the amnesty scheme is improved clarity. If eligible buildings can complete the OC process, thousands of families may gain stronger documentation and greater confidence in their homes.
