Supreme Court Restores Construction Curbs at The Imperial Tardeo

The Supreme Court has restored construction restrictions at The Imperial, the 60-storey twin-tower luxury residential development in Tardeo, providing interim relief to existing homeowners.
Nearly 50 flat purchasers from Towers A and B had challenged revised building plans and proposed additional construction within the development.
The dispute had earlier reached the Bombay High Court, where restrictions were imposed preventing additions or alterations to Towers A and B without residents’ consent. Construction of another building, Tower C, was also capped at 38,500 sq. metres of built-up area.
Parts of those restrictions were subsequently stayed by a division bench while the developer’s appeal was being considered.
Residents then approached the Supreme Court, which has now directed that the earlier interim restrictions will continue while the appeal remains pending.
The Supreme Court has also asked the Bombay High Court to hear the developer’s appeal on an out-of-turn basis, subject to cooperation from the parties.
For Mumbai’s property market, the dispute highlights the importance of disclosures made to buyers regarding layouts, future construction and development potential within large residential projects.
This becomes particularly relevant in luxury developments, where buyers may attach substantial value to open spaces, views, privacy and the overall density of a project.
